There have been many cases filed by exempt vs. non-exempt attorneys arguing that pharmaceutical sales reps should be entitled to overtime pay for working overtime hours. The argument relies on the proposition that drug sales reps are not actually making sales as required by California overtime laws and the Fair Labor Standards Act. After all, the drug sales reps cannot actually sell the drugs to a physician; at most the doctor can agree to prescribe the drug to patients as necessary. 

The issue of whether drug sales reps are entitled to overtime pay is so important and controversial that the Supreme Court of the United States has decided to take on the issue. It is expected that the Supreme Court will have a decision on whether drug sales reps are entitled to overtime pay in June 2012.
